§ 10-243. Possession of wildlife within the city limits.

  • The following terms used in this section are defined as follows:

    Possess or possessing shall mean possession, keeping, harboring, or permitting to remain.

    Wildlife shall mane any Class I or Class IV wildlife as classified by Section 70-4-402(a)(1) Class I of the Tennessee Code Annotated.

    It is declared unlawful for any person to possess wildlife on or about their premises within the city limits of the City of Clarksville, except as hereinafter provided.

    Any person possessing wildlife on or about any premises within the city limits of the City of Clarksville shall first make application to the chief of police, or his designated agent, for a certificate to permit such possession; such certificate shall contain such information as may be required by the chief of police. A fee in the amount of fifty dollars ($50.00) shall be paid to the police department with the application. Those funds shall be the funds of the police department to be administered by the department in law enforcement as the department sees fit.

    Upon receipt of an application as just referred to and prior to issuance of a certificate permitting possession as hereinabove set out, the chief of police, or his designated agent, shall file a resolution seeking approval by the city council for the City of Clarksville of issuance of such certificate, which resolution shall be voted on at the next regular or called meeting of the city council, and in the event it does not receive a favorable vote of the majority of the entire membership of the city council, the certificate shall be denied, but the fifty dollar ($50.00) fee shall not be returned, but will remain with the department for purposes above set out.

    The provisions of this section shall not prohibit the possession of wildlife by zoos or transient circuses, and no certificate shall be required in these instances.

    The certificate above referred to shall be valid for a period of one year from its date of issuance and may be renewed on an annual basis thereafter by the applicant paying an annual fee of twenty-five dollars ($25.00) for each renewal; renewals do not require approval of the city council unless the wildlife is to be or has been moved to a new location, in which event city council approval shall be required.
